General Terms & Conditions
This is an English rendering of our Greek General Terms of Participation, provided for convenience. Where the two differ, the Greek text prevails.
Please read carefully these General Terms of Participation (the "GTP"), which concern the package trips organised by our Travel Organiser. The GTP have been drawn up in accordance with Presidential Decree 7/2018, which transposes Directive (EU) 2015/2302 into Greek law, and form an integral part of the package travel contract. A "package trip", within the meaning of Presidential Decree 7/2018, is the pre-arranged combination of at least two different types of travel service for the same trip, such as transport and accommodation and/or other tourist services that are not ancillary to transport or accommodation, where the service exceeds 24 hours or includes an overnight stay and is offered for sale at an inclusive price. Participation in any package trip of our Travel Organiser presupposes careful study of the programme of that particular trip and means the Traveller's unreserved acceptance of the GTP. The GTP contain general information as well as the rights and obligations of the Travel Organiser and of the Traveller respectively in the package trip. For specific information (destinations, programmes, services, prices, duration, departure and return times, means of transport, accommodation and so on) concerning each individual package trip, you should consult the programme in force at the time and the relevant price list. Programmes apply for the period stated in the relevant brochures or on our website www.dreamroute.gr.
Organiser — Travel Organiser
Our Company, under the name "DREAM ROUTE E.E." and the trading name "THE DREAM ROUTE", with its registered office at Mpoumpoulinas 16, 18863, Perama, Attica, General Commercial Registry number 195972309000, Travel Agency Register (ΜΗ.Τ.Ε) number ΧΧΧΧΧΧΧΧΧ, telephone 213 0470 293 and email [email protected] (the "Travel Organiser", or "THE DREAM ROUTE", "we"), organises trips either on its own or in joint venture with other travel agencies, or acts as an intermediary between other travel agencies and carriers, with the aim of selling package trips to travellers (the "Traveller" or "Travellers", "you").
General
The information, details and recommendations contained in the GTP have been checked by the Travel Organiser for validity and accuracy, are general in nature and apply as they stand, unless something more specific or different is stated in the programme of a particular trip. Programmes, including their prices, apply for the period stated in them. The information and details of trip programmes may change because of exceptional circumstances. In that case you will be notified promptly by the most suitable means, and we must therefore hold all your contact details, for the declaration and updating of which you alone are responsible.
Registrations — Bookings — Participation in package trips
Registrations are made by email, through our website or in person at our offices, on condition (in order for places on the particular trip to be held) of: a) payment of the deposit applicable at the time or of the full amount (as the case may be), in cash or by transfer to the Travel Organiser, within 72 hours, and b) unreserved acceptance of and compliance with these GTP. For a valid registration, the deposit transfer must state the destination together with the departure and return dates, your full name and any other identifying details, and proof of the bank payment must be sent by email within the time specified to you, normally within 72 hours; otherwise your booking is treated as void. Telephone bookings, or bookings of any other kind, that are not confirmed by payment of the corresponding deposit and followed by acceptance of the GTP do not oblige the Travel Organiser to make any reservations.
To complete the booking, a clear photocopy or photograph of your passport must be sent by email. Please check your passport, as the Travel Organiser bears no liability in the event of an error in the ticket or in any other reservation. Where a ticket is cancelled because of a change of name or an expired passport, cancellation charges may apply. Finally, the right to take part in the trip is secured by payment in full of its value and the related charges thirty (30) days before departure, unless the relevant Contract provides otherwise. Failure to pay the full value of the trip within the time allowed entitles the Travel Organiser to cancel the booking and, where applicable, to claim cancellation charges in accordance with the cancellation terms set out in these GTP.
The tourist services to be provided and their cost are described in detail in the package travel contract (the "Contract"), which is required and must be signed by all Travellers or by anyone acting as their representative. Any cancellation by the Traveller is governed exclusively by the cancellation terms of these GTP and of the particular programme.
Prices — Surcharges
The value and price of trips are given on our website for each trip, or are made known to you in the course of your communications with our Travel Organiser. Trip prices are calculated on the day the trip is announced, on the basis of the costings of the services of each trip, the cost of fuel or other energy sources, the fares and surcharges in force, taxes and charges of every kind, the exchange rate of foreign currencies against the euro, and every other cost factor (for example a minimum number of participants). Having exhausted every possibility of forecasting, the Travel Organiser reserves the right to adjust prices when the above cost factors change. In particular, any increase in the price of a trip may arise solely from a change in: a) the cost of fuel or energy, b) third-party taxes or charges, or c) exchange rates. Any price increase will be notified to the traveller, itemised in a clear, comprehensible and prominent manner, no later than twenty (20) days before the start of the travel services. Where the price increases significantly, that is by more than 8% of the value of the trip, for the reasons above, the Traveller may within three (3) days of being notified cancel their participation and be refunded the money they have paid, or be offered another trip of equal value. The Traveller is obliged to notify our Travel Organiser of their decision within a reasonable time, which in no case may exceed three (3) days from the moment the price increase is notified to them.
If the Traveller does not reply in writing within the above period, the Travel Organiser is obliged to cancel their participation and refund all money they have paid, with no further obligation, taking into account the related cancellation charges set out in the relevant clause of these GTP.
Prices for taxes and visas have been calculated on the basis of the data in force at the date the price list was issued and may be amended up until the trip takes place.
The Travel Organiser is entitled, for a particular period or for a limited number of places, to sell places in advance at more favourable prices, with special cancellation terms.
Obligations and liability of DREAM ROUTE E.E.
Our Travel Organiser is obliged to co-ordinate and carry out in the best possible way the package trips it makes available to Travellers. It is not liable for the non-performance or defective performance of the agreed travel services to the extent that this is due to: a) acts or omissions of the Traveller themselves, b) a third party unconnected with the provision of the travel services included in the package trip, where the circumstance in question could not have been foreseen or avoided, or c) cases of force majeure. Force majeure means events outside the Travel Organiser's sphere of control which could not have been avoided even if all reasonable and appropriate measures had been taken, such as, by way of example and not of limitation: severe weather, natural disasters, epidemics or pandemics, fires, floods, earthquakes, strikes, political events, war, a state of war or the threat of war, acts of terrorism, closure of areas, and cancellations, delays or changes to transport schedules for technical, meteorological or other reasons. In the above cases the Travel Organiser is not obliged to pay compensation, but is obliged to make every reasonable effort to support and assist Travellers and to provide the assistance required by law, without undue delay, in particular by providing information and help in finding alternative solutions.
The Travel Organiser cannot foresee or control delays or changes to transport schedules and, for that reason, Travellers would do well to avoid planning important personal activities or other travel on the days of departure and return. Any effects on the programme are dealt with within the framework of the package travel contract and the applicable legislation.
The Travel Organiser makes every possible effort to deal with incidents such as loss of or damage to luggage, or loss of money or travel documents, without this implying the assumption of liability beyond the limits laid down by international conventions and applicable law. Any complaints during the trip must be reported immediately and on the spot to the tour leader or to the Travel Organiser, so that they can be addressed in good time.
Where a minimum number of participants is required for a package trip to take place, that number is stated in the programme or in the relevant information. If that number is not reached, the Travel Organiser reserves the right to cancel the trip and refund the amounts paid, or may propose alternative solutions where this is feasible.
Catering services included in the programme of a package trip are provided by third-party partners (for example hotels and restaurants). In cases of health problems that may arise during the trip (for example food poisoning, allergic reactions or other similar conditions), the Traveller is not entitled to compensation where the Travel Organiser proves that the lack of conformity is attributable to the Traveller themselves, in particular where known allergies, intolerances or sensitivities were not declared, or where relevant health and safety instructions were not followed.
In the event of a health problem during the trip, the Travel Organiser will provide appropriate assistance, without however substituting for medical services or insurers.
The Travel Organiser provides only the services expressly stated in the programme of the package trip. Any optional activities are provided at an additional charge, where it proves possible to run them, and are subject to the specific terms of the providers concerned. On organised excursions, the tour leader or local representative may be replaced for organisational reasons, without this affecting the overall performance of the trip as described in the programme. In addition, where the minimum number of participants required (15 people) is not reached, the trip may still go ahead with the support of a local representative at the destination, without a representative of the agency accompanying the group throughout. In that case the Traveller is informed in good time and, where that change amounts to a significant alteration of a main characteristic of the package, retains the rights provided for by Presidential Decree 7/2018.
Obligations and liability of travellers
Because other people are also taking part in the package trip, appropriate social behaviour is essential, as is travellers' full compliance with the trip programme and with the instructions of tour leaders or guides, and their punctual arrival at the meeting points for the various services in the programme (flights, transfers, guided tours, excursions, meals and so on). If a traveller's lateness or unreliability results in a flight, excursion, transfer or other service being missed, the traveller must rejoin the group at their own responsibility and expense, with no right to a refund for the service missed or for the trip as a whole if they fail to rejoin. The Travel Organiser will make every possible effort to assist them, without having or assuming any obligation or liability. Unreliability, besides the other problems it creates, entitles the tour leader to disregard the inattentive client and the Travel Organiser to refuse any compensation for services that were not provided. Where a traveller interrupts their trip by their own decision and leaves the group, they are entitled to no further service or compensation, and the responsibility and cost of any travel outside the group falls on them alone. Clients and travellers are expected to comply with all rules, instructions and directions laid down by the Travel Organiser and by any appointed trip leaders or guides during the trip. Otherwise the Travel Organiser may proceed to immediate exclusion or cancellation from the trip without refund or compensation. Likewise, disruptive behaviour or disrespect towards others — including, by way of example, the organisers, fellow clients and travellers, leaders, guides or local residents — will not be tolerated and may lead to removal from the trip. Finally, the Travel Organiser reserves the right to terminate a client's or traveller's participation in the trip if they do not comply with these terms and conditions. The decision to terminate a traveller's participation rests in the sole judgement of the Travel Organiser.
For all trips abroad a new passport is required, valid for at least six months beyond the scheduled return date. Schengen countries also accept the new identity cards which show the holder's details in Latin characters. Identity cards for use within the Schengen area must have been issued within the last 15 years. Participants in package trips are solely responsible for the validity of their travel documents, for obtaining and safeguarding them in good time, and for the truthfulness of their declarations to Greek or foreign monetary and customs authorities. Nationals of other countries holding foreign passports or residence permits must inform themselves and approach the consular authorities of their own country, and of the countries they will visit, in order to check whether they need an entry visa or any other documents for the countries they will pass through or travel to, and for their re-entry into Greece or into the country they set out from. Failure to obtain travel documents or visas in good time does not justify cancellation of participation without cancellation charges.
The Travel Organiser provides all information about any vaccinations or other medical precautions required for areas with tropical or other epidemics. Because this involves personal medical data, however, clients are themselves responsible for approaching the competent health authorities. Travellers are obliged to inform themselves in good time from their local health offices about the health regulations of each country, and about any vaccines or medicines they may need to obtain. Clients with health problems (older people, pregnant women, people with mobility difficulties) must inform the Travel Organiser and obtain their doctor's agreement before travelling. Where, although aware of a health problem, they register for a package trip and have not informed the Travel Organiser of that existing health problem, DREAM ROUTE E.E. bears no liability for any complication during the trip arising from it. DREAM ROUTE E.E. likewise bears no liability for illness, injury, loss of life, accident or other medical emergency during the trip. Should such an event occur, the Travel Organiser will support the person affected as far as possible, but is under no obligation to cover any related expense. Since the excursion must continue normally for the remaining travellers, the Travel Organiser's staff in the area (leaders, tour leaders, representatives and so on) cannot remain with the person affected during their treatment or hospitalisation beyond reasonable limits — limits set by the need for the programme of the rest of the group to continue smoothly. The Travel Organiser reserves the right to interrupt a traveller's trip and arrange their return to Greece if, in its judgement, their health or life, or that of the other travellers, is at risk. Any costs fall on the client and traveller.
Travellers are obliged to comply with national provisions and regulations and with the instructions of national authorities. The Travel Organiser bears no liability where a traveller faces criminal prosecution, is summoned before an authority, is arrested by the local authorities or similar.
Where a client is prevented from taking part in the package trip for which they have booked a place, they may transfer their booking to another person who meets the conditions for taking part in that particular trip, no later than 15 working days before departure. Where an amount remains owing, or additional costs arise from the transfer (for example because the new client is of the other sex), the transferor and the transferee are jointly and severally liable to our agency for payment. Any consequent compulsory cancellation of the booking will be made in accordance with the cancellation terms provided for in this document.
Finally, you should be at the airport at least two (2) hours and thirty (30) minutes before your departure, unless you are told otherwise by the agency or by the tour leader.
Hotels — Accommodation
All information concerning the categorisation or classification of the hotels and accommodation mentioned in the programmes of our package trips is in accordance with the legislation in force in each country for the tourist classification of hotels and accommodation, which may differ from country to country. Depending on the destination, rooms in most hotels have two beds or one double bed. Triple rooms are in essence twin rooms with an extra bed. They are usually not especially comfortable, and the extra bed may be smaller than a normal one, or a sofa or a folding bed. Rooms are usually released by the hotel between 14:00 and 16:00 and are available to guests until 10:00 to 12:00 on the day of departure (depending on each hotel's policy). If you wish to check in earlier or leave later, you will need to pay the relevant charge (where there is availability). If, because of unforeseen difficulties, a Traveller has to change to another hotel of the same or a higher category, the Travel Organiser is under no obligation to pay compensation.
On certain trips the Travel Organiser may offer solo travellers the option of sharing a twin room with another solo traveller of the same sex, if they wish. The Travel Organiser is not liable for any incompatibility, disagreement or problem that may arise between room-mates, provided the agreed allocation procedure has been followed and there is no fault on its part. It is not obliged to change the room or to provide a single room free of charge. In every case the Travel Organiser will make a reasonable effort to find a solution where that is possible. Any additional costs that may arise (for example an upgrade to a single room or a change of accommodation) fall solely on the travellers and not on the Travel Organiser.
In the event of overbooking, our Travel Organiser will try to replace the room with another hotel room of the same category or, if that is not possible, with a hotel room of a lower category, and will refund the Traveller the resulting difference, with our Travel Organiser bearing no further liability or obligation.
We recommend that you do not leave personal belongings (mobile phones and the like) exposed, and that you keep them under your supervision at all times, in any setting — hotel, ship, aircraft and so on.
Airlines
The Travel Organiser provides economy class air tickets, which are based on special fares (group fares and/or special agreements with airlines). These fares may be subject to restrictions, such as no changes or cancellations being possible, and no award of miles or other loyalty benefits. Flights are operated by the partner airlines, which are responsible for operating them. The Travel Organiser is not liable for changes to schedules, delays, flight cancellations, changes of aircraft type or other modifications made by airlines for operational or other reasons, where there is no fault on its part.
In cases of overbooking, airlines may refuse boarding to passengers even with a confirmed reservation. In such cases the airline is responsible for providing alternative transport (usually on another flight the same or the following day) and for paying any compensation provided for by applicable legislation (for example Regulation (EC) 261/2004). The Travel Organiser is not obliged to pay additional compensation for any loss of services or activities in the travel programme caused by such incidents, where there is no fault on its part. In cases of flight delays or cancellations due to force majeure or extraordinary circumstances (for example weather conditions, strikes, air traffic restrictions and so on), the airline is responsible for providing passengers with the care required (for example accommodation, meals, transfers) under applicable European legislation. The Travel Organiser is not obliged to pay additional compensation for such circumstances, where there is no fault on its part. Where the Traveller's return becomes impossible because of such circumstances, the Travel Organiser is in every case obliged to provide the Travellers with the assistance necessary to deal with the situation, as provided by applicable legislation.
Airlines reserve the right, for operational reasons, to operate their flights with aircraft of another airline (wet lease or code share). This does not constitute grounds for the traveller to cancel the trip, nor does it give rise to a right to compensation, where the provision of transport is not materially affected. In-flight services (for example meals, extra baggage, seat selection and so on) are determined solely by the airline concerned and by the fare policy. In some cases they may be provided at an additional charge. Travellers must comply with the terms and conditions of the airline concerned and bear any related charges. The Travel Organiser is not liable for such charges or services, where there is no fault on its part. The Travel Organiser cannot guarantee the allocation of particular seats, nor that travellers will be seated together on the aircraft, since the final allocation of seats is made by the airline. Where a traveller wishes to pre-select a seat or to sit with a fellow traveller, they may submit a request, which will be met where this is possible and in accordance with the airline's terms. Any additional charges arising from selecting or reserving seats fall solely on the traveller. Where a traveller does not present themselves in time for the outbound flight (no-show), or misses the departure for any reason, the retention or use of the return ticket is subject solely to the terms and policy of the airline concerned. In line with the usual practice of airlines, not using the outbound flight may result in the automatic cancellation of the subsequent legs of the ticket, including the return flight. The Travel Organiser is not liable in such cases, nor obliged to pay compensation or to reissue tickets free of charge, where there is no fault on its part.
Transport — Transfers
Travel during the trip (for example transfers to and from airports, excursions and local journeys) is carried out by tourist coaches, mini buses or other means of transport which meet the requirements of the country concerned and of applicable legislation. Transport is carried out by partner local transport companies. In the event of delays, changes to schedules or changes to the means of transport caused by unavoidable and extraordinary circumstances (for example traffic conditions, weather, technical issues or strikes), the Traveller is not entitled to additional compensation. The Travel Organiser is, however, obliged to offer alternative arrangements where that is possible.
Coach seats are not numbered unless stated otherwise, and are taken in order of boarding or according to the tour leader's instructions. The Travel Organiser cannot guarantee a particular seat throughout the trip. Travellers are obliged to keep to departure times and to the tour leader's instructions. In the event of lateness or failure to appear at a pre-arranged meeting point, the means of transport may depart without them, with no obligation to pay compensation or refund arising, where there is no fault on the part of the Travel Organiser.
On certain trips, for example to destinations such as Iceland or the United States, the Travel Organiser may offer the option of travelling by hire car (self-drive), provided by partner car hire companies. In those cases travellers are informed in advance that travel is not by an accompanied means of transport (such as a coach) but by vehicles driven by themselves or by other members of the group.
Travellers may ride as front-seat or other passengers in vehicles driven by other members of the group, by their own choice and with their own consent. The Travel Organiser does not provide transport services with a professional driver in these cases. The Travel Organiser takes care to select a reliable hire company and is liable for any defective vehicles or for a negligent choice of provider. The Traveller is not entitled to compensation where any damage is attributable to them, in particular in cases of breach of the Highway Code, negligent driving or failure to comply with the hire company's terms of use.
The terms of use, insurance and liability for the vehicles are governed by the contract the traveller enters into with the hire company concerned. Travellers must meet the necessary requirements for driving (for example a valid driving licence, age limits and so on) and comply with the relevant terms. Any additional charges arising from the use of the vehicles (for example fuel, tolls, fines, damage or additional insurance) fall solely on the Travellers.
Luggage
Luggage is carried at the responsibility and in the care of its owners, whether or not representatives of our Travel Organiser are accompanying the group. In the event of damage or loss, the relevant international conventions for each means of transport and for hotels apply, and liability in that case is limited to what those conventions provide. The Travel Organiser bears no liability for the contents of luggage.
On air travel, where one (1) checked bag per passenger is permitted, the maximum weight is normally 20 kilos. Where additional costs arise because luggage weighs more than the allowance, these fall solely on the Traveller and are paid on the spot at the airport. Note also that airlines allow only one small item of hand luggage in the cabin (roughly 50x40x25) weighing 8 to 10 kilos. Travellers are obliged to comply with the instructions, regulations and general policy of the airline concerned on the matter of excess baggage, for which that airline alone is responsible, and the Travel Organiser therefore bears absolutely no liability for it. In the event of damage or loss, the IATA Regulation applies.
Insurance
In compliance with European Directive 2015/2302 and Presidential Decree 7/2018, the Travel Organiser has taken out, for every excursion it organises, a professional liability insurance policy with NP Insurance (policy number 2224031388). The policy covers, among other things, cases of liability of the Travel Organiser in accordance with its terms, as well as the case of its insolvency, securing the protection of Travellers irrespective of their place of residence.
Individual travel insurance (for example cover for personal accident, illness, medical expenses, loss of luggage or cancellation of the trip for personal reasons) is not part of the compulsory cover required by Presidential Decree 7/2018 and is not provided automatically as part of the package trip. For that reason Travellers are strongly advised to take out individual travel insurance that adequately covers their personal needs. On certain trips the Travel Organiser may, as a service to Travellers, offer group travel insurance at no extra charge through a partner insurance company. In those cases the cover is provided in accordance with the terms and conditions of the policy concerned, runs for a specific period and is subject to set maximum compensation limits. Travellers must inform themselves in advance about the terms, the cover and the maximum compensation limits of the insurance provided, and judge whether it is sufficient for their needs. Where the insurance provided does not cover them, they may take out supplementary or additional travel insurance at their own expense. Should an insured event occur during the trip, the Traveller is obliged to contact the insurance company immediately, following the instructions and contact details given to them, and to follow the procedures laid down in the policy. The Travel Organiser and the tour leaders do not substitute for the insurance company and are not liable for assessing or covering insured events, where there is no fault on their part. Every reasonable effort will nevertheless be made to assist the Traveller as far as possible.
Excursion programme
The Travel Organiser makes every possible effort to carry out trip programmes as well and as faithfully as it can. Even so, and because changes which the Travel Organiser cannot control may occur between the date the programmes are announced and the date the excursion takes place, some details may not agree exactly with what is stated at the time the excursion is run (for example a museum or other attraction being closed, or technical problems with hotel facilities and equipment). The Travel Organiser bears no liability for the opening days and hours of markets, museums and archaeological sites. Unforeseen situations may make it necessary to vary the programme before departure or during the excursion. Before departure, the Travel Organiser reserves the right to modify the trip programme because of factors beyond its control, such as delays or cancellations of transport schedules, changes to hotel categories because of problems with buildings or because hotel bookings were not properly checked, or because of extraordinary events or cases of force majeure in the country where the trip takes place.
In the event of a significant alteration to the main characteristics of the package trip before departure, or in the event of cancellation, the Traveller's rights (including the right to terminate without charge, where that is provided for) are governed by Article 10 of Presidential Decree 7/2018 and by these GTP.
During the trip, the leader or local representative has the right to make changes to the trip programme when dealing with an extraordinary event, such as cancellations or delays of transport schedules or cases of force majeure. Any additional costs (extra overnight stays, meals, transfers and so on) which are not covered by the Contract, by legislation or by any insurance cover, and which arise from the Traveller's own choices or actions, fall on the Traveller.
During the trip, Travellers may be offered optional activities or excursions which are not included in the programme or in the total cost of the package trip. Such suggestions are made purely for information, usually through the tour leader or local partners. The choice to take part in such activities is made at the Traveller's own initiative and responsibility, and they contract directly with the local provider concerned. The organisation, performance, terms of participation and pricing of these activities are determined solely by the third-party providers. The Travel Organiser and the tour leaders are not liable for the provision, safety, quality or performance of these optional activities, to the extent that they do not form part of the agreed package travel contract.
Where activities are included in the programme of the package trip and, by their nature, may involve an increased degree of difficulty and/or risk (for example rafting, horse or camel riding, driving ATVs or buggies, hiking at high altitude or in demanding natural environments, water sports, climbing, canyoning, zip lines and so on), these are carried out by partner local providers, as a rule licensed ones. The Travel Organiser takes care to select these providers on criteria of professionalism and safety. The Traveller's participation in such activities presupposes good physical condition, suitable health and compliance with the instructions and safety terms of the provider concerned. Travellers must assess their own capabilities before taking part. The Traveller is not entitled to compensation where the damage is attributable to them, in particular because of failure to follow safety instructions, concealment of health problems, or participation contrary to the provider's directions.
Cancellations
Cancellations of participation by the Traveller are made only in writing (by email) to our Travel Organiser and, irrespective of the date of booking (and where it is not possible to transfer the booking to another person under clause 6 of these GTP), are subject to the following cancellation charges per person, depending on when the cancellation is made, and irrespective of whether the corresponding amounts have already been paid by the travellers or not.
The cancellation charges reflect an estimate of the administrative costs and/or the commitments and charges towards third-party providers (such as airlines, hotels and other suppliers) which cannot be recovered because of the cancellation, and are applied in accordance with the programme concerned and the providers' terms.
Cancellation terms may differ depending on the package trip, in particular because of the specific terms of partners (airlines, hotels, local providers and so on). In every case, the specific cancellation terms stated in the trip programme and/or in the confirmation email for participation prevail over these general terms.
For trips abroad (and where no different cancellation policy is imposed by the carrier or the hotel):
- Up to 3 months before departure: €100 per person, for administrative costs.
- From 3 months to 60 days before departure: 50% of the total value of the trip.
- From 60 to 30 days before departure: 75% of the total value of the trip.
- From 30 days before departure up to and including departure (no-show): 100% of the total value of the trip.
Note that in cases of non-refundable fares the cancellation charge is 100%, as determined by the airline and stated in the trip programme or in the email setting out the registration procedure.
Charges apply irrespective of when the registration was made or of whether the corresponding amounts have already been paid by the Travellers or not. Where one of two people who have chosen to share, or are sharing, a twin room cancels their participation, they will pay the corresponding cancellation charges. Where those cancellation charges do not amount to 100% of the total value of the trip, the person who does travel will also pay the room difference, since they will necessarily be staying in a single room.
Cancellation of participation without cancellation charges is possible only in the case of unavoidable and extraordinary circumstances occurring at the destination or in its immediate vicinity which significantly affect the performance of the package trip or the carriage of passengers to the destination, in accordance with Presidential Decree 7/2018. Such circumstances include, by way of example, serious security issues (such as armed conflict directly affecting the destination), natural disasters or other situations of force majeure which make the trip objectively impossible or materially dangerous. Whether such circumstances exist is judged on objective criteria and on the basis of the actual conditions prevailing at the destination in the period before departure, in particular where there are official measures or binding instructions from the competent authorities (for example a travel ban, closure of borders or suspension of flights), without this being the sole condition.
General concerns, personal fear or a subjective assessment of risk on the Traveller's part, as well as events that do not directly affect the destination or the performance of the trip (for example developments in neighbouring or wider geographical areas with no material effect on the trip), do not constitute grounds for exemption from the cancellation charges provided for. In addition, changes to the programme that do not materially affect the main characteristics of the package trip (for example a change in the order of visits, the replacement of individual attractions or activities, or minor variations in the programme) do not constitute grounds for cancellation without cancellation charges.
Settlement of disputes
The Travel Organiser and the Traveller undertake to settle in good faith any dispute that may arise in the performance of the Contract. If an amicable settlement of the dispute proves impossible, the Courts of Athens have jurisdiction.
